Have you ever seen the beautiful house next to the
dilapidated shack? One house has a manicured lawn, with
tasteful landscaping. The neighbor...the lawn is so high
you can only see the roof. And this is for the best
because the trim is rotting, the gutters sagging, and the weeds
conceal the rodents.
One of the main methods a home owners association (HOA) has
to maintain property values and consistency is deed
restrictions. Deed restrictions are guidelines and
standards for the neighborhood, covering everything from
construction materials to home maintenance.
Why is that person driving my neighborhood taking notes and
pictures?
Twice a month, the HOA manager drives the
neighborhood looking for violations. No, this is not
a witch hunt. She is looking for major items that
have a significant impact on the neighborhood.
Sometimes, it may be for items such as fence repairs or
replacing damaged trim. Other times, it may be for
overgrown lawns, grass growing over the curb, or for items
stored in the driveway or yard. Our legal
documents-specifically our deed restrictions-form the
basis of her review.
If a discrepancy is found, the homeowner is notified.
A post card is used for initial violations. Years back,
we switched to this format because a formal letter seemed to be
overkill for leaving your trash can out! If the violation
continues, or for repeat offenders, a formal letter is
used. If this is ineffective, the board can vote to take
legal action.
